Pacess wellness Partner are the exclusive distribution channel for Pacess wellness’s products(“Products”).Pacess wellness Partner have the ability to purchase Products directly from Pacess wellness and personally consume or sell the Products to their customers. Throughout the Policies, the terms “Distributor,”“Pacess wellness Partner,” “you,” “Sponsor” and “Advisor” shall refer to any person whose Distributor Agreement has been signed, received and accepted by Pacess wellness in its sole and absolute discretion.
In order to become a Distributor, you must: Be at least 18 years of age; Reside in a geographic area where Pacess wellness conducts its direct selling business; Submit a signed Distributor Agreement and signup under an existing Pacess wellness Partner Distributor as a Sponsor; and Purchase a Distributor Kit.
A signed Distributor Agreement constitutes your agreement with Pacess wellness Partner, and acknowledges your understanding that you must adhere to the Pacess wellness Policies, which are incorporated into the Distributor Agreement as part of the Contract. Providing false information in your Distributor Agreement may result in the immediate termination of your Pacess wellness Partnership. Additionally, Pacess wellness reserves the right to refuse any application in its sole discretion.
You may change your contact information (including your mailing address, phone number and/or e-mail address) online through your Distributor Website or by contacting Pacess wellness Partner Customer Service.
Pacess wellness Partner does not permit Pacess wellness Partner to change Sponsors .However ,a Distributor may choose to either: (1)resign from his or her Pacess wellness Partnership ,subject to all the terms and conditions that apply to a resignation ,wait six (6) months from the date of resignation and start over as a new Distributor ,enrolling under the Sponsor of his or her choice
Distributor positions do not automatically rollup when they are vacated .Rather ,when a position is vacated for any reason ,either voluntarily or involuntarily ,the vacated position will remain in its current position in the Pacess wellness Partner organization ,and its down line organization will remain intact ,until at least the time that Pacess wellness partner has recouped all costs and losses ,including attorney’s fees ,associated with there as on the position has been vacated ,such as a Distributor’s termination and the events that are connected with or led to the termination. This provision includes all costs, fees, and expenses. Associated with litigation that may result from or be connected with such termination.
Once Pacess wellness Partner determines, in its sole discretion, that it has recouped all such costs and losses ,the vacated Distributor position may be removed from Pacess wellness Partner’s organization, and the down line organization may rollup to the immediate up line Distributor, all in the sole discretion of Pacess wellness partner .No Pacess wellness Partner shall have any vested right or claim in the roll-up of any vacated position in Pacess wellness partner’s organization, regardless of whether the position has been vacated through voluntary resignation involuntary termination, or otherwise. The decision whether or not to rollup a particular position after it is vacated is always within the sole discretion of Pacess wellness partner.
If a vacating Pacess wellness partner sponsored any Preferred Customer(s) or Registered Retail Customer(s), those Preferred Customer(s) and / or Registered Retail Customer(s) may rollup to the immediate up line Distributor, in the sole discretion of Pacess wellness partner.
A Pacess wellness partner shall only participate directly or in directly in the operation and development of one account with Pacess Wellness Partnership or a Preferred Customer membership. A Pacess Wellness Partner shall not retail, recruit ,promote, train, educate or otherwise as assist in the development of any other Pacess Wellness Partner Pacess wellness partnership other than their own, except to assist their down line organization ,as is appropriate for a Sponsor or to assist other Pacess wellness partner .An exception to this restriction is if the Distributor is serving as a trustee on another Pacess wellness partnership(refertoChapter13:DispositionofaPacess wellness partnership –Death or Legal In capacity for details).
Pacess wellness partner will only accept a Distributor Agreement in the name of the individual(s) .Applications in the name of a corporation, partnership or business entity will not be accepted.
If an individual is found to been rolled or participating in two or more Pacess wellness partnerships simultaneously ,the first Pacess wellness partnership will be considered the valid Pacess wellness partnership. If Pacess wellness partner determines that an individual is operating two or more active Pacess wellness partnerships, Pacess wellness partner has sole and absolute discretion to determine the disposition of the affected Pacess wellness partnerships ,as well as any penalties or sanction sit deems necessary and appropriate for the Pacess wellness partnership. An individual that signs more than one Distributor Agreement, or operates in more than one Pacess wellness partnership, may have any and all Pacess wellness partnerships suspended or terminated in Pacess wellness partner’s sole discretion.
